The publication known as Wisconsin Laywer has published some tips for attorneys on deposition taking. In a nutshell, you have to a) Explain the process; b) Follow your outline; c) Listen to the witness; d) Be curious; e) Don’t be deterred by objections; f) Keep your cool.

Apparently, these and other tips for successfully deposing lay and expert witnesses are culled from the authors’ many years of experience and varied practice areas.
